These Terms & Conditions govern the use of services providedby Marketingly. By engaging our services, you agree to the termsoutlined below.
1. Our Services
Marketingly provides marketing services on a subscription basis.Services may include digital marketing support, social media management,website-related assistance, advertising management (including Google Ads whereapplicable), and performance reporting. The exact scope of services will beagreed in writing.
2. Access & Authority
By using our services, you authorise Marketingly to accessrelevant platforms, tools, and accounts as required to deliver the agreedservices. Access will be used solely for this purpose.
3. Pricing & Payments
All pricing is agreed in advance and charged on a subscriptionbasis. Invoices must be paid within the stated payment period. Failure to paymay result in suspension or termination of services.
4. Intellectual Property
Any intellectual property owned by either party prior to theengagement remains their property. Marketing materials created by Marketinglybecome the client’s property once full payment has been received, unlessotherwise agreed.
5. Confidentiality
Marketingly treats all client information as confidential. Bothparties agree not to disclose confidential or commercially sensitiveinformation to third parties without consent. This obligation continues afterservices end.
6. Data Protection
Marketingly complies with the UK GDPR and the Data Protection Act2018. We process personal data only where necessary to provide services, storeit securely, and do not sell or misuse personal data. Where applicable,Marketingly acts as a Data Processor and the client acts as the DataController.
7. Advertising Platforms
Where advertising services are provided, including Google Ads,clients acknowledge that all platforms are governed by third-party policies anddecisions. Marketingly does not guarantee ad approvals, account availability,or specific performance outcomes. Advertising spend is paid directly to theplatform and is separate from Marketingly’s fees.
8. Performance & Results
Marketingly aims to provide consistent, high-quality marketingservices. However, results may vary, and no specific outcomes or growth levelsare guaranteed. Marketingly is not responsible for changes caused bythird-party platforms, algorithms, or market conditions.
9. Limitation of Liability
Marketingly is not liable for any loss of earnings, revenue, orbusiness opportunity arising from the use of our services. Our liability is limited to the amount paid for services in the preceding three months.
10. Termination
Either party may end services with reasonable notice. Upontermination, Marketingly will cease services and remove access to client platforms.
11. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
